GLOBAL WAR ON TERROR: OLEH AMERIKA SERIKAT DALAM PERSPEKTIF HUKUM INTERNASIONAL
Abstrak: Global war on terror
that is analysed in the perspective of the International Law entails two problems. Firstly, the
relevance of international humanitarian law in the context of global war on
terror, and secondly, the regulations of terrorism that is depicted in the
Geneva Convention I-V 1949 and the
Additional Protocol I-II 1977. United
States of America used the international humanitarian law to legitimate the aggression
over Afghanistan in the name of war on terror.
On the other hand, in response to the September 11, 2001 attacks, the
Bush Administration issued the Military Order 12,333, which is far beyond the
well implementation of humanitarian law.
Those people who was captured in the
context of war on terror, is deemed as enemy combatant and unprotected
under Geneva Convention 1949.
