Hukum Dan Partisipasi Publik Dalam Pemberantasan Korupsi
Abstract: Efforts to fight
corruptions are closely related with the establishment of anticorruption legal
measures as well as the required institutional back-up. However, there is another
factor that is sometimes overlooked: public participation. This paper
identified how public participation in combating corruption is accomodated in
the 2003 United Nations Convention Against Corruption (UNCAC) and in the
Indonesian Anticorruption Law (Law No. 31/1999 as amended by Law No.20/2001).
Reporting corruption cases is a form of public participation in fighting
corruption. In this regards, the Indonesian Anticorruption Law has provided
enough space for the protection of witnesses and reporters of corruption cases,
but the legal norms should be equipped with the implementing rules and
institutions.
