KEBIJAKAN PENYELENGGARAAN KEKUASAAN KEHAKIMAN SEBAGAI KENDALI PEMBENTUKAN PENGADILAN PENGADILAN KHUSUS Dl INDONESIA

Abstract: The aim of the study is to analysis do the establishment of particular courts recently is accordance or notwith the power justice implementation under the similar roof of Supreme Court and giving an advice the ideal formulation of the establishment of particular courts within rein of under the similarroof of Supreme Court. This study is normative or doctrinal research as law is being concepted as positive norms within legislation system. The research take place any places in which can be used to access library material concerningto research data, especially library resources. The type of data is seconder data concerninglaw that consist of primer law material, seconder law material and law tertiary material. The collecting data technique is using library study In analyzing data Is using the logical deduction method. Alter being analysed the conclusion showing that from the four types of particular courtthat established after the exist ofjustice power implementation policy under the similarroofof Supreme Courtas being formulated within article 11 the law number 35/1999 concerningthe revisionof the law number 14/1970 concerningofjustice Power and the recently is at article 10 law number 4/2004 concerningthe Justice Power. The three types of particular court such as: Human Rights Court, Corruption Courtand Industrial Relationship Court are in accordance with the such policy. The exeption is the Taxes Courtis regarded is not inline withjustice power implementation policy under the similarroofof Supreme Court, Forthe future the establishment ofparticu larcourt should not contrary withthe justice powerimplementation policy under the similarroof of Supreme Court. For the future the establishment of particularcourts should formulatedby an act, should be placed under the single trial environment such as: common trial environment or religion trial environment or military court environment or administration court environment. As well as the procedure implemented supposed to follow the procedure law of the type of such trial environment and also place Supreme Courtas the highest court bodies at Indonesia.
