Kekuasaan Kehakiman dalam Konstitusi dan Praktiknya di Negara Indonesia
Abstract: The judicial
independence is a freedom of court to conduct of judiciary in order to enforce
law and justice. The independency of court can not be separated from principle
of check and balance, democracy, human rights, rule of law and constitutionalism
of Indonesia. Formation and existence of Constitutional Court in Indonesia
related to its principles because of their function. Constitutional Court is one
of judiciary body which is formed to conduct judicial review of some acts or government
decisions with constitution of Indonesia 1945. This article examines the various
aspects of this problem, such as the general conception of independency of court,
Constitutional Court as a subject of judicial independence, and the role of Constitutional
Court independency to enforce law and
justice in society
