PELAKSANAAN KEMITRAAN POLA DAGANG UMUM Dl BIDANG KERAJINAN KERAMIK Dl KABUPATEN BANTUL YOGYAKARTA
ABSTRACT: This research
aimed to find
out the reasons
of small-scale entrepreneur
for adopting a partnership of General Trading Pattern, the resolution by
the parties for a failure of
responsibility, and the
problems encountered in
the resolution for unfulfilled responsibility. The
research was done
in Bantul regency,
Yogyakarta Special Region. It exactly located in sub-districts Kasihan,
Sedayu, and Pundong The subjects were 1) respondents, selected based on a
purposive sampling among the
small-scale, medium scale,
and big-scale entrepreneurs, who
adopted a partnership of
General Trading Pattern,
2) resource persons
from the National Handicraft Board
(DEKRANAS) of Bantul
chapter, the Department
of Trade, Industry, and
Cooperative (DEPERINDAGKOP), and PT Jamsostek.
The research used the
primary data obtained
directly from the
subjects using interviews with
all respondents and
resource-persons. The secondary
data for support were obtained
from the library study by studying legal materials relevant to the
research material. The
research applied a
qualitative analysis using
an interactive analysis model.
The research presented
the following findings.
First, the reasons of
small-scale entrepreneur to
have a partnership
of General Trading Pattern were the social and economic
problem, small capital assistance given and lack of extension, difficult access
into international market, problem of formality of business
agreement, problem of
production development, and
limited human resources. Second,
the resolution by the parties for a failure of responsibility was made through
a mutual deliberation.
Third, the problems
encountered by small-scale
entrepreneur in the
resolution for unfulfilled
responsibility resulted from inability to
fulfil his responsibility when
a failure of
responsibility occurs, weaknesses
of the clause of the agreement causing uncertainty of resolution, lack of understanding
on the agreement
content, particularly by
small-scale business having such
a partnership with
big-scale or medium
scale businesses, and
the perception of the party writing an agreement by regarding it as only
for formality.
