KAJIAN YURIDIS MOU 1974 INDONESIA DAN AUSTRALIA DALAM MELINDUNGI HAK NELAYAN TRADISIONAL INDONESIA DI PERAIRAN PULAU PASIR (ASHMORE REEF) MENURUT UNCLOS III 1982

ABSTRAK: MOU ( Memorandum Of Understanding ) is a memorandum of agreement that is  held by both countries, It is often used in cases where the parties made a legalcommitment in situations where the parties can not create a legally enforceableagreement which is followed by two State the promise, the MOU could have a binding force for the parties who have legal problems, which they face, so that issues raised Authors About Settings in protecting the rights of Indonesian Traditional Fishermen according to the 1974 MOU is an agreement between the Government of Indonesia and the Government of Australia on what are the rights of Traditional rights Fishermen Indonesian Traditional fishermen (Traditional Fishing Right). The method used in this study is a normative law, the results of this study it can be concluded that the 1974 MOU Juridical Studies in protecting the rights of Indonesianfishing in Australian waters, especially in the waters of Sand Island (Ashmore Reef), an attempt to overcome the obstacles faced in the implementation of protection oftraditional fisherman in waters off Ashmore Reef has been a lot going on, a violationof the regulation because there is still a fisherman catching incident due to allegations of Illegal Fishing. Results found in the 1974 MOU juridical studies because of differences in the understanding of the two countries. the MOU in 1974the need for unity of opinion on the definition of Traditional  Traditional Fishingright
