ABSTRACT: The ulayat land in
Minangkabau consist of nagari’s ulayat, suku’s ulayat, kaum’s ulayat and rajo’s
ulayat. Ulayat kaum land are the land of kaum communal that arrangemen using of
that land depend on Mamak Kepala Waris. In Payakumbuh occurred the lawsuit
between the kaum’s members with the childs and wife of Mamak Kepala Waris
caused the registration process of ulayat kaum land based on personal name of
Mamak Kepala Waris, because the there have proprietary based of personal name
of Mamak Kepala Waris. The problem of this research are: how do the steps
registration process of ulayat kaum land based on personal name of Mamak Kepala
Waris? What is the caused of registration of ulayat kaum land based on personal
name of Mamak Kepala Waris? What is the consequences of registration based on
personal name of Mamak Kepala Waris?.the form of research is the sociological
research that used the primary data and secondary data as a source of data. By
the result of this research, the researcher process of ulayat kaum land based
on personal name of Mamak Kepala Waris occured because that is easier in
registration process or for the bail in the bank. The consequences of that
registration of ulayat kaum land based on personal name of Mamak Kepala Waris
can to buying selling, give grant/ donate the ulayat kaum land without asking
the agreement to the kaum’s members before.
